SPARK Motion provides 3D animation, CGI production, motion design, 3DOOH content, FOOH content, and related creative services to brands and agencies.

The scope, timeline, pricing, and deliverables of each project are defined in a separate written agreement or proposal. These Terms apply alongside any such agreement. In case of conflict, the project-specific agreement takes precedence.

3. Use of the Website

You may use our website for lawful purposes only. You agree not to:

• Use the website in any way that violates applicable law

• Attempt to gain unauthorized access to any part of the website or its systems

• Transmit harmful, offensive, or disruptive content

• Scrape, copy, or reproduce content without written permission

4.2 Client Deliverables

Ownership and licensing of deliverables are defined in the applicable project agreement. Unless otherwise agreed in writing, full intellectual property rights in final deliverables transfer to the client upon receipt of full payment.

SPARK Motion retains the right to use project work in its portfolio, case studies, and promotional materials unless the client requests confidentiality in writing.

5. Client Obligations

Clients engaging SPARK Motion agree to:

• Provide accurate briefs, reference materials, and feedback in a timely manner

• Ensure they have the rights to any materials (logos, footage, music, assets) provided for use in production

• Review and approve deliverables within the timeframes specified in the project agreement

• Make payments according to the agreed schedule

Delays caused by the client may affect project timelines. SPARK Motion is not responsible for delivery delays resulting from late feedback or missing client assets.

6. Payments

• Projects typically require a deposit before work begins

• Invoices are issued in EUR or RON as agreed

• Payment is due within the timeframe specified on the invoice

• Late payments may result in work being paused until payment is received

• All prices are exclusive of VAT unless otherwise stated

7. Revisions and Changes

The number of revision rounds included is specified in the project agreement. Revisions beyond the agreed scope may be subject to additional charges. Significant changes to the brief after work has commenced may require a revised proposal and timeline.

8. Confidentiality

Each party agrees to keep confidential any non-public information received from the other party in connection with a project, and not to disclose it to third parties without prior written consent. This does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

9. Limitation of Liability

To the maximum extent permitted by applicable law, SPARK Motion shall not be liable for indirect, incidental, or consequential damages, loss of revenue or profits, or damages resulting from delays or interruptions outside our reasonable control.

Our total liability for any claim shall not exceed the total fees paid by the client for the specific project in question.

10. Indemnification

You agree to indemnify and hold harmless SPARK Motion from any claims, losses, or expenses arising from your breach of these Terms, your unlawful use of our services, or any materials you provide that infringe third-party rights.

11. Third-Party Links

Our website may contain links to third-party websites for convenience only. We are not responsible for their content or practices.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania.
